1. Introduction


1.1. These Terms and Conditions govern the provision of driving tuition provided by Lloyds Driver Training Ltd to students requiring such tuition. They apply where the student is a "Consumer" as per the Consumer Rights Act 2015.


2. Definitions & Interpretation


2.1. In these Terms and Conditions, the following expressions shall have the meanings assigned to them unless the context dictates otherwise:
2.2. "Business" means any trade, craft, profession, or other form of enterprise conducted by You or another party.
2.3. "Consumer" is an individual customer of the Instructor, receiving tuition for personal use, and for purposes mostly unrelated to any Business.
2.4. "DVSA" refers to the Driving & Vehicle Standards Agency.
2.5. "Instructor" refers to a driving instructor assigned to You from Lloyds Driver Training Ltd.
2.6. "Price List" is the Instructor's standard list of charges for driving tuition.
2.7. "Student" refers to the individual receiving driving instruction.
2.8. "Parent / Guardian" refers to a person with legal responsibility for the Student, if the Student is less than 18 years old.
2.9. "Regulations" refers to The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.


3. Driving Instructor


3.1. All driving instructors are self-employed, independent driving instructors, not employed by a driving school when providing tuition under these Terms and Conditions. Andrew Lloyd is the owner/Director of Lloyds Driver Training Ltd.
3.2. All instructors are registered with the DVSA


4. Driving Lessons: Booking, Cancellation & Delays


4.1. A lesson will be made available to You only if You have pre-booked it. You should book a lesson directly with your Instructor.
4.2. Your request to book a lesson is considered an offer, which the Instructor may choose to accept or decline. A binding contract exists between You and the Instructor upon acceptance of Your lesson request.
4.3. If you wish to book multiple lessons at once, and the Instructor accepts this, the contract will encompass all the lessons involved.
4.4. Lessons slots are not reserved except for when a particular lesson slot is booked by You.
4.5. If you anticipate being late for a lesson, inform the Instructor. If You are 10 minutes late, the lesson may be treated as cancelled without notice, and the Instructor may charge for the lesson.
4.6. You may cancel a lesson without charge given at least 48 hours prior notice.
4.7. If You cancel a lesson with less than 48 hours notice, the Instructor may charge You for any net financial loss they incur due to Your cancellation, up to the full price of the lesson.
4.8. In exceptional circumstances, such as illness, accidents or bereavement, the Instructor may waive any late cancellation charges.
4.9. The Instructor may cancel a lesson without incurring any liability to You.
4.10. The Instructor may cancel a booked lesson at any time before the start if they are unable to provide the lesson fully due to reasons beyond their control. In such case, any advance payment made by You will be fully refunded.
4.11. If the Instructor has reason to believe You are not fit to drive at the time of the lesson, they may cancel the lesson and decide to charge you.
4.12. The Instructor will strive to start the lesson on time, but the start may be delayed due to overrun of a previous lesson or other circumstances.
4.13. If a delay to the start of a lesson is at least 15 minutes, You may cancel and will not have to pay for that lesson.
4.14. You may cancel any lesson(s) during the 14-day period after the Instructor accepts the booking, as per the Regulations


5. Lessons: Location & Length


5.1. The Instructor will agree on the location for each lesson with You. They may choose a location that requires additional travel for the sake of road safety. Travel time will form part of the lesson time in such cases.
5.2. The minimum length of a lesson is one and a half hours, which can be extended by increments of 30 minutes up to a maximum length of 2 hours.


6. Fees & Payment


6.1. All lessons must be paid for, with instructors charging on an hourly basis. Current lesson fees are available from the Lloyds Driver Training website or your instructor. Instructors will provide notice before any fee changes. Payment methods include debit card, credit card, cash, or bank transfer. Receipts are available upon request.


7. Your Instructors Obligations


7.1. Your instructor will provide driving instruction at the agreed times, train you to a high standard, and be professional and courteous. They will follow the DVSA Code of Practice and laws.


8. Your legal Obligations


8.1. You need to have a valid UK driving licence and present it when requested.
8.2. You will provide proof of eligibility if you're training for a retest
8.3. You will meet visual standards, wear glasses or contact lenses if prescribed,
8.4. You will inform your driving instructor about medical conditions or medications affecting driving ability. If these obligations are not met, the instructor can cancel the lessons.


9. Your Cleanliness and Personal Hygiene Requirements


9.1. As the driving instructor's vehicle serves as their workplace, it is imperative to maintain a clean and comfortable environment for both the instructor and the pupil during lessons. Therefore, you must adhere to the following cleanliness and personal hygiene requirements: It is your responsibility to be aware of and adhere to these cleanliness and personal hygiene requirements. Failure to comply with these standards may result in the termination of your driving lessons, and any fees paid in advance for cancelled lessons may be forfeited.
9.2. Your clothing will be free of dust, dirt and pet hair.
9.3. You must maintain a reasonable level of personal hygiene for the duration of your driving lessons. This includes, but is not limited to, regular bathing or showering, using deodorant, and maintaining oral hygiene.
9.4. If the instructor, at their sole discretion, deems that your clothing is excessively dirty or dusty, or that your personal hygiene is unacceptable, they reserve the right to cancel the lesson immediately. In such cases, the instructor may still charge for the cancelled lesson.


10. Vehicles & Insurance


10.1. The instructor ensures that vehicles used are roadworthy, taxed, have a valid MOT, and are insured for driving instruction. If you wish to use your own vehicle, it must meet similar requirements and be approved by your instructor.


11. Driving Tests


11.1. Your instructor will inform you when you're ready for a test. You're responsible for booking your theory and practical tests. If Your instructor books your driving test fees must be paid at the time of booking. You need to bring required documentation to the
test, else the test may be cancelled. Your instructor will attempt to provide an alternate vehicle if their vehicle is unavailable on the test day.


12. Cancellation & Termination


12.1. Your instructor may end your tuition for substandard conduct, progress or commitment. You may also terminate your tuition, subject to cancellation notice requirements.


13. Liability


13.1. Your instructor is liable for foreseeable losses resulting from their breach or negligence. However, they aren't liable for unforeseen losses, loss of profit, or business interruption.


14. Changes to Terms & Conditions


14.1. Your instructor may change these terms and conditions without notice, but will aim to inform you as soon as possible.


15. Your Personal Information (Data Protection)


15.1. Your personal data will be collected, processed, and held according to the GDPR. Further information is available on the Lloyds Driver Training website.


16. Regulations


16.1. Your instructor will provide you with the necessary information required by the Regulations before making a contract with you.


17. Information


17.1. All information provided to you by your instructor will be part of your contract.


18. Complaints


18.1. Your instructor welcomes feedback and aims to provide high standard tuition. Any complaints can be directly addressed to them or Lloyds Driver Training.


19. No Waiver


19.1. Failure or delay in exercising any rights under these terms and conditions doesn't waive those rights.


20. Law & Jurisdiction


20.1. These terms and conditions, the contract, and the relationship between you and your instructor will be governed by English law. Any disputes will be subject to the jurisdiction of the courts in the UK.
